TERMS AND CONDITIONS OF ELECTRONIC PURCHASE OF HEALTHCARE SERVICES OFFERED BY LUMEDIC WITHIN THE SCOPE OF MEDICAL ACTIVITIES
Given that LuMedic provides the User with the possibility to:
– purchase healthcare services by making an electronic reservation for a visit to LuMedic,
– make payments through the online payment system
and taking into account the requirements of the Act of 18 July 2002 on the provision of services by electronic means (i.e. Journal of Laws of 2017, item 1219, as amended), this Regulation has been prepared.
DEFINITIONS:
Service Provider – Healthcare entity – Paweł Napiórkowski conducting business under the name LUMEDIC PAWEŁ NAPIÓRKOWSKI with its registered office in Warsaw, ul. ks. Ignacego Kłopotowskiego 11, lok. LU04, postal code 03-718, NIP: 7971680840, REGON 387988968 and conducting medical activities within the LuMedic healthcare facility based on entry in the Register of Entities Conducting Medical Activities kept by the Mazowieckie Voivode, entry no. 000000253849 – hereinafter referred to as LuMedic;
User – Patient or a person who is a statutory representative, legal guardian, or authorized person acting on behalf of the Patient requesting the provision of healthcare services and/or using healthcare services provided by the Service Provider by booking a visit at LuMedic and paying for it through the Service Provider’s website;
Service – electronic reservation of a visit at LuMedic to receive healthcare services and payment for the visit through the lumedic.pl website.
Regulation – regulation on the provision of services by electronic means as referred to in the Act of 18 July 2002 on the provision of services by electronic means (i.e. Journal of Laws of 2020, item 344);
Website – Service Provider’s website www.lumedic.pl;
Consumer – a natural person with full legal capacity, making a purchase from the Service Provider not directly related to their business or professional activity.
BASIC INFORMATION:
1. It is the User’s obligation to familiarize themselves with the content of the Regulations before starting to use the Services.
2. Commencing the use of Services covered by the Regulations is equivalent to familiarizing oneself with the content, understanding, and full acceptance of the terms of the Regulations.
SCOPE OF SERVICES:
1. The Service Provider provides an electronic service for booking a visit to LuMedic and payment transactions for the reserved healthcare service.
2. The Service Provider provides Services free of charge.
CONDITIONS FOR PROVIDING SERVICES BY ELECTRONIC MEANS:
1. To use the Service, it is necessary to have:
– access to the Internet
– an email address
– an updated web browser
– a bank account.
2. When using the Website, the User is obliged to:
– provide true, correct, accurate, complete, and non-misleading personal data;
– not transfer content of an unlawful nature
– use legal software,
– have regularly updated antivirus software and a firewall.
3. The User’s browser should have security settings at least at a medium level.
4. Disabling the Cookies function does not block the possibility of using the Services, but in some situations, it may lead to difficulties in connecting to the Website. The Service Provider is not responsible for difficulties in using the LuMedic Website resulting from the User’s disabling of Cookies support.
5. During the provision of Services, the Service Provider ensures secure data transfer and authorization processes, which are carried out using a secure SSL protocol.
6. The provision of Services is protected against access by third parties.
7. The User is responsible for the correctness of the data provided by them, as well as for the consequences of providing incorrect, untrue, incomplete, or misleading data.
8. Using the Service requires the User to provide:
– the first and last name of the Patient
– User’s email address
– User’s phone number
9. The User is obliged to accept the Regulations.
10. The Service Provider is not responsible for the User providing untrue, incorrect, or incomplete information, especially in the case of providing third-party data without their consent or knowledge.
CONCLUSION AND TERMINATION OF THE AGREEMENT:
1. Conclusion of the Agreement occurs upon payment through the electronic payment system to LuMedic’s bank account, after exchanging information between LuMedic and the person having access to the email address and telephone number provided in the appropriate form, to which the visit confirmation will be directed.
2. The Agreement is concluded for a specified period covering the provision of the Service.
WITHDRAWAL FROM THE AGREEMENT:
1. A Client who is a consumer and has concluded a distance or off-premises contract has the right to withdraw from it without giving a reason within 14 days.
2. The withdrawal form from the agreement constitutes Annex No. 1 to the Regulations.
3. The declaration of withdrawal from the agreement should be sent by email to: recepcja@lumedic.pl
4. The right to withdraw from the Agreement does not apply to the Consumer if:
– the Service Provider has already provided a healthcare service resulting from the concluded agreement;
– the performance of the healthcare service has commenced with the explicit consent of the Consumer before the expiry of the withdrawal period.
COMPLAINTS:
1. The User has the right to lodge a complaint related to the provision of the Service.
2. The complaint should indicate the reason for the complaint and the User’s request.
3. The complaint should contain the User’s data enabling their identification.
4. The Service Provider shall consider complaints immediately but no later than within 14 days from the date of its receipt.
5. The User has the possibility to lodge a complaint electronically at the email address recepcja@lumedic.pl or at the correspondence address: ul. ks. Ignacego Kłopotowskiego 11, lok. LU4, 03-718 Warszawa.
OUT-OF-COURT WAYS OF CLAIMS ENFORCEMENT
1. The Consumer has the option to use out-of-court methods of settling complaints and enforcing claims.
2. The Consumer has, among others, the possibility to:
– apply to a permanent amicable consumer court to resolve a dispute arising from the concluded Agreement,
– use the assistance of the district (municipal) consumer advocate or a social organization, whose statutory tasks include consumer protection.
3. Detailed information on out-of-court methods of settling complaints and enforcing claims can be found on the website http://www.uokik.gov.pl.
4. The Consumer can also use the ODR platform, available at http://ec.europa.eu/consumers/odr. The platform is used to settle disputes between consumers and entrepreneurs seeking an out-of-court settlement of a dispute concerning contractual obligations arising from an online services agreement.
FINAL PROVISIONS
1. These Regulations come into force on 20.02.2023 and apply to Agreements concluded with the User after their entry into force.
2. In the event of changes to the Regulations, the version of the Regulations in force on the date of placing an order by the User applies to agreements concluded before such changes.
3. Matters not regulated in these Regulations shall be governed by the provisions of:
– the Civil Code of 23 April 1964 (Journal of Laws No. 16, item 93, as amended);
– the Act on the provision of services by electronic means of 18 July 2002.
4. All disputes arising between the Service Provider and the User related to the provision of services by electronic means under these Regulations shall be settled by the competent court determined according to the provisions of the applicable law.
